Covid-19: Help, I have a Child Arrangements Order. Do I have to comply with it?

Any court order has to be taken seriously as failure to comply can mean you end up back before the court.

However, we have received guidance from the court and the government has also clarified the position.

Parents may pass their children between households during the current lockdown.

This means you can legally comply with your order.

Whilst we are in lockdown you may decide what is in your child’s best interests. If you decide that it is not in your child’s best interests to go from household to household you may comply with the lockdown rules without fear of the court criticising you.

If you do not move your child between households during the crisis you must, if possible, facilitate indirect contact on the telephone or by digital methods. You could use Skype, Facetime or Zoom to name but a few of the options.

Children worry and not seeing the other parent may cause them to worry about their absent parent’s health. Seeing a parent, even digitally can make a positive difference.
