Divorce Day is just a myth
For many people Monday 6th January 2025 will mark the return to normality after the festive period with the return to work or school. What it will not be is divorce day. Every year the media like to portray the mythological idea of Divorce Day – that on the first working Monday in January divorce solicitors up and down the country are spending their first day back with a full diary of meetings with new clients who want to start divorce proceedings because they have had one too many arguments with their partner over the Christmas turkey. The media also like to claim that the HMCTS portal, which solicitors are now required to use to file divorce proceedings, sees a higher-than-average spike in new cases being submitted on the 6th January which cannot be further from the truth.
For the majority of family solicitors, the first working Monday is usually spent catching up on emails and work on existing case files. Some may well have appointments with new clients but regardless of when a client decides to speak to a family solicitor, anyone considering formally ending their marriage will not take the decision lightly. Before making such a big change to their lives, some want to be back in the routine of work and have the children back at school before they summon the determination to meet with a family solicitor and get the process started. Such a decision can come after months or even years of deliberation, worry, pain and sadness.
